233 Asilo en el Reino Unido: un derecho restringido Asylum in the United Kingdom: a restricted right Ximena Vengoechea 1 “Pero yo ya no soy yo, ni mi casa es ya mi casa” — Federico García Lorca, Romance Sonámbulo ABSTRACT This article aims to present a critical overview of the asylum system in the United Kingdom. It is written having in mind those in different jurisdictions and those who are unfamiliar with the basic rules and procedures which regulate the way in which asylum claims are dealt with in the UK. The initial sections of the article are of a general nature: They define the concept of asylum and provide elements for the reader to distinguish between various categories of cross-border migrants. The middle sections focus on the various normative instruments engaged in the process of asylum seeking and decision- making specific to the UK. The latter sections follow the journey of a claim from the initial contact with UK border authorities to the decision by the Home Office, through to the appeal process in the immigration and appellate courts, with reference to leading case-law where relevant. By choosing to present the content in this way, the author seeks to demonstrate how the legislative framework and the procedures for asylum in Britain turns the unqualified, universal right to asylum into a restricted one, thus circumventing the provisions of the 1951 UN Convention on the Status of Refugees . RESUMEN El presente artículo se propone dar una mirada general, pero no por ello menos crítica, al sistema de asilo en el Reino Unido. Ha sido escrito teniendo en cuenta a quienes, estando en otras jurisdicciones, no se encuentran familiarizados con los procedimientos legales en el sistema británico, particularmente en lo que se refiere a la solicitud de asilo.
