This article defends the thesis that under such scenario the judiciary - and in particular, the constitutional justice - must take responsibility for its essential role as guarantor of the rights of persons in the context of human mobility, a historically unprotected group and in a situation of vulnerability. To this end, it advanc- es some thoughts regarding the conventionality control in the matter from a twofold standpoint: that which refers to the development and implementation of Inter-Ameri- can standards, as well as that relating to effective access to justice.
